"Nine deer king" trademark dispute settled

Recently, at a customer order conference held by Jiangsu Jiulu Wang Garments Co., Ltd., Qian Renlong, the company's chairman, officially announced that after more than four years of legal battles, the trademark case of "Nine Deer King" Fashion Co., Ltd. has finally reached a favorable conclusion. The Beijing Higher People's Court recently issued its final ruling in the trademark dispute, revoking the "Trademark Review and Adjudication Opinion No. 1725087" issued by the State Administration for Industry and Commerce regarding the "Nine Deer King" trademark. This decision also overturned the administrative judgment from the First Intermediate People's Court of Beijing in 2009 (Case No. 302). After years of struggle, the combination of "Nine Deer Wang" and "Nine Deer King" has now been legally recognized. It is worth noting that Beijing Nine Deer King Garments Co., Ltd. is a leading enterprise specializing in men’s clothing. "Nine Deer King" is its flagship brand. Since obtaining the "Nine Deer King" trademark, the company has focused on developing its brand strategy, establishing China's first-class casual men's design team, and heavily investing in brand promotion and image enhancement. The company has built nearly 800 sales outlets nationwide and contributes hundreds of millions of yuan to the textile and garment industry each year. In June 2005, Inner Mongolia Nine Deer King Cashmere Co., Ltd. applied to cancel the "Nine Deer King" trademark, arguing that it was similar to their own. Despite the efforts of Beijing Nine Deer King Garments Co., the Trademark Review and Adjudication Board and the Beijing Intermediate People's Court ruled in favor of the cancellation of the "Nine Deer Wang" trademark. However, in April 2009, the Supreme People's Court issued an opinion on IP trial services under the current economic situation, which marked a turning point in the case. Eventually, the Beijing High People's Court ruled in favor of protecting the legitimacy of the "Nine Deer Wang" trademark, by revoking the previous decisions made by the State Administration for Industry and Commerce and the Beijing First Intermediate People's Court. This long-awaited victory not only reaffirms the strength of the brand but also highlights the importance of intellectual property protection in China’s evolving business environment.
