The shipping company lost 8,800 yuan to the garment industry and commerce department to order compensation

A garment agent worth 8,800 yuan, recently purchased by an individual business owner, was entrusted to a logistics company for delivery. However, the goods were lost during transit. The shipping company only offered to compensate 10 times the shipping fee, which left the customer deeply dissatisfied. On December 8, the local industry and commerce department ruled that the standard contract clause used by the consignment company was invalid, citing unfair terms. On the 2nd, Zhou Xiaolan, a small business owner from Fuzhou City in Jiangxi Province, filed a formal complaint with the Shukou Industrial and Commercial Bureau. She explained that she had bought the 8,800-yuan garment agent from Li Daolin, who operates a stall at Zone B, Center Mall on Hanzheng Street. After purchasing the item, she arranged for it to be shipped to Fuzhou. Unfortunately, the package never arrived. The shipment was handled by "Clear Logistics Express," with a shipping fee of 105 yuan. According to the company’s representative, the goods were indeed lost, but the sender had not opted for an insured service. As a result, the company claimed they could not determine the actual value of the goods. Since it was classified as regular consignment, their maximum liability was limited to 1,050 yuan. Li Daolin, the seller, stated that the shipping company had failed to explain the standard terms of the contract when the package was sent. The industrial and commercial department agreed, stating that the format contract was likely void due to its one-sided nature, possibly constituting an "overlord clause" that favors the company over the consumer. After several rounds of negotiation, the logistics company finally agreed to pay 4,000 yuan as compensation for the lost goods. In addition, Li Daolin offered Zhou Xiaolan an extra 1,400 yuan in compensation, bringing the total settlement to 5,400 yuan. This resolution helped ease the tension between the parties, though it highlighted the importance of understanding and reviewing contract terms before shipping valuable items.
